<MOD> Sorry, Brian. Although these are simulations rather than the real thing, it's still pretty grey as to wether or not Tom will permit these ROM images on the forum.

No hard feelings, just want to play it safe.</MOD>

None at all...

Was it really nessary to remove my whole post though?

Ehhh, I was just curious what would be the correct terminology. Simulated sounds good enough to me!

But, if these games are simulated, then that means that no code was taken from the copyrighted material so they should be in the clear, right? Take for example Pong. That had no code and the rom in MAME was actually just a simulation. Does anyone think that should be considered a no-no?

It doesn't really matter either way since these are easily obtainable with a google search. It just seems like there should be some leniency in some cases. On the other hand, these games appear to display the NINTENDO logo which is trademarked. Thus perhaps there would be an infringement there?

I will not repost..

BUT here is my argument.

If this were a ROM what emu author packages roms WITH emulators...NONE because they would get their ass in a sling.

If you are familiar whit MUGEN I see this as very simular(a collection of sprite rips and sounds). Its FAN art. Someone took a picture of a hand held,Someone re drew the backroud behind the LCD.Somone recorded the little beep it makes when you jump in a WAV. They put it together and SIMULATE how it works. There is no Emulator(Program that is interpeting ROM code that is not theirs) No ROM images that they do not have the copyright to. The way they use the nintendo logo is no diffrent then the way we all use it here in the themes.(Lets not remove those as well ;) ) This program and the others are really just a tribute to the past.

That was more of an accident really... After I realized I changed your whole post it was already too late. I apologize.

When it comes to Nintendo, they get pissed about everything. Best to be safe. Nintendo is notorious for making a big deal out of nothing.

As far as MUGEN goes, the ripped sprites ARE illegal, most game programmers and copyright holders look the other way on them though... But I would have removed a torrent link to mugen just as quickly. This is the GameEx forum above all else and I don't see a need to even take that risk. There's no grey area there.

Nothing personal, just a little damage control. :)

Possibly, but XArcade has had Playboy bunnies playing with their controllers on old 80's games, so unless they're nerds too... B)
